Excerpt from the Austrian terms of Contract for Hotels
1. Conclusion of Agreement, Advance Payment
As a rule, the acommodation contract is concluded by the Accommodator´s acceptance of written or verbal reservation of the guest.
An advance payment to be made by the guest may be agreed upon.
2. Withdrawal from the Accommodation Contract.
Up to three months prior to the guest´s agreed date of arrival, the contract may be teminated unilaterally by either party without a cancellation free. The contractual partner must be in receipt of the noticeof cancellation at least three months prior to the guests agreed date of arrival.
No less than one month prior to the guest´s agreed date of arrival, the contract may be terminated unilaterally by either party, in which cace, however, a cancellation fee equivalent to payment for three nights´ lodging is to be paid. The contractual partner must be in receipt of the notice of cancellation at least one month prior to the guest´s agreed date of arrival.
The Accommodator has the right ro withdraw fraom teh contract if the guest does not arrive by 6.00 p.m on the day agreed, unless alter arrival time was previously arranged.
If the guest has, however, made an advance payment, the accommodations remains reserved until 12.00 noon of the following day at the latest.
Even if the guest does not occupy the accommodations and/or take meals, he is obliged to pay the atreed amount to the Accommodator. The Accommodator must, however deduct the savings he has incurred because services were nor used or the earnings gained by renting the accommodations to other guests. Experience has shown that in most cases, the savings resulting from non-use of services are equivalent to 20% of the room rate and 30% of the board rate.
The Accommodator is to make a genuine effort to other-wise rent the unutilized accommodations .
